Should there be stricter punishments for people that brandish #guns in public?

State laws guide the public use of a firearm in Florida. It is an offense to brandish or exhibit a firearm carelessly or in a threatening manner. The crime is called Improper Exhibition of a Firearm or other Weapon as defined under Section 790.10 of Florida Statutes. Under Florida law, the improper exhibition of a firearm or weapon is classified as a first-degree misdemeanor. The offense carries penalties of up to a year in jail or 12 months of probation and a $1,000 fine. 

There is no need for stricter punishments for offenders of this law; the existing law is severe enough to serve as a deterrent to prospective offenders.

Furthermore, stricter punishments for brandishing guns in public will discourage people from having guns in their baggage because not everybody exhibits firearms to harm, threaten or cause danger to others. Some people display firearms as a form of self-defense, in defense of others, or in defense of personal property. The enforcement of stricter laws against the use of guns in public may discourage people from carrying guns, which may put their lives or personal properties in danger when an attack occurs. 

More so, the conviction of an offender with the present law is not an easy process due to the number of conditions that the prosecutor must prove before the jury. This means passing a new law with a stricter punishment will not change anything.

Therefore, the initiative for new laws against the brandishing of guns is not needed and will not be of any benefit. Instead of making new laws, people with licensed firearms can be educated on how to use firearms in public without causing panic or pandemonium. 

The police cannot be everywhere at any time. Thus, an individual with a gun can save lives in the incidence of an attack. The formulation of new laws to restrict the use of firearms will do more harm than intended good.

In conclusion, the current law guiding the use of firearms in public is strict enough to deter people from the improper exhibition or brandishing of firearms in public. The most important move to make in improving the use of firearms in public is the education and orientation of people on the use of firearms in public places.
